Hush-Hush.com Terms & Conditions

YOU MUST READ, AGREE, AND ELECTRONICALLY 'SIGN' THESE TERMS AND CONDITIONS BEFORE YOU CAN JOIN HUSH-HUSH.COM. PLEASE READ THEM CAREFULLY. IF THERE IS ANY PART YOU DO NOT UNDERSTAND OR AGREE TO, PLEASE DO NOT JOIN.

  1. By enrolling in the Hush-Hush.com Service, you agree to be bound by these terms and conditions. The terms and conditions are subject to change by Hush-Hush.com (Fax 2000 Pty. Ltd., Australia) at any time, and changes are effective upon the posting of them on the page that you are now reading. (These terms and conditions are just common sense, but unfortunately in today's world we do have to state them.)
  2. You understand that Hush-hush.com is owned by Fax 2000 Pty Ltd (ABN: 86 082 873 309) in Australia and all charges, singular or monthly, will be equivalent to either $15, $37.50 or $60 Australian dollars (or 20% less with active renewal), depending on the length of membership and currency rates at the time of purchase.
  3. Club subscribers are responsible for paying periodic subscription fees according to the then-current billing terms. Fees may be paid online at Hush-Hush.com with a valid credit card, by cash or by Paypal. Concerns regarding this policy should be sent to support@hush-hush.com.
    (If for any reason you are unhappy with your subscription, don't complain to your mother, don't complain to your credit card company, don't complain to your dog or cat, and don't hold it in and harbour resentment. Instead, let us know how and/or why you are unhappy and give us a chance to see if there is anything we can do to make you a little happier.)
  4. Subscriptions may not be assigned or transferred to any other person or entity. Subscriber agrees to immediately inform Hush-Hush.com of any apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of a Subscriber's password or other account data. A Subscriber's liability in cases of unauthorized use of the Hush-Hush.com system may raise substantially in cases where Subscriber is aware of security breach but does not inform Hush-Hush.com of such breech in a timely manner. Unauthorized access to Hush-Hush.com is a violation of law. (This is a sreious matter -- DO NOT SHARE YOUR LOGIN DETAILS!)
  5. Subscriptions to Hush-Hush.com may be terminated at any time, with or without just cause, by either Hush-Hush.com or the Subscriber upon written notification to the other. Subscribers are liable for all charges, including memberships purchased, up to and until end of current membership period. If you choose to have automatic membership renewals on this system, then later decide to cancel your membership, you must let us know 7 days before rebilling is due.
  6. Subscribers, particularly those on automatic rebill, agree to email support@hush-hush.com and advise if they plan to go away on a vacation, business trip, or if they will be in a situation where they cannot check email, so that they can arrange for their account to expire at the end of the current billing period. If you fail to do this, then you agree to pay for all account renewals which occur whilst you are away. You will always receive a written response from support@hush-hush.com to confirm that you have contacted us - you cannot claim your email got "lost in cyberspace" after the fact.
  7. Users must accept that if they submit a photo or joke to win free membership, and then go away on a vacation, business trip, or any other event occurs that prevents them from checking their email, that they forfeit all awarded free days which were granted whilst they were away. It is your responsibility to check you email daily to ensure you know that you have won at the time the free membership is granted (remember, all winner emails are sent 7 days after an update).
  8. To prevent fraud, Subscribers using credit card to purchase their subscription must provide their full name and address, as shown on their credit card statement. Failure to provide accurate information will result in suspension of the subscription without notice, until such a time the accurate name and address has been provided. To remove a suspension, Subscribers must provide accurate information either by email to support@hush-hush.com or by updating their personal information in the Member Admin Area. Subscribers must then notify the Support Department in order to have the new details verified within 24 hours. Once verified and deemed accurate, the suspension is removed. While an account may be suspended, the number of days remaining on the subscription is not suspended and the subscription expiry remains the same as the date the subscription was purchased.
  9. Subscribers agree to immediately inform Hush-Hush.com of any changes in credit card number, expiration date, Subscriber address, or similar information.
  10. No warranty is made by Hush-Hush.com regarding any information, services, or products provided by or through the online service, including not limited to, any warranties as to the availability, accuracy, or content of the information or services provided herein.
  11. Any messages submitted by Subscribers to Hush-Hush.com shall be submitted to the proper e-mail address. Mail sent in to an obviously wrong e-mail address will probably be lost in the electronic jungle. A list of our contact e-mail addresses is on the FAQ page.
  12. Submitters of media content to Hush-Hush.com (Fax 2000 Pty Ltd) shall be solely responsible for your own submissions and the consequences of posting or publishing them. In connection with submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorise Hush-Hush.com (Fax 2000 Pty Ltd) to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all submissions to enable inclusion and use of the submissions in the manner contemplated by the Website and these Terms of Service.
  13. This Agreement, and all business conducted under it, shall be governed by the laws of New South Wales, Australia.

WARRANTY DISCLAIMER:
YOU AGREE THAT YOUR USE OF THE HUSH-HUSH.COM (FAX 2000 PTY LTD) WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, HUSH-HUSH.COM (FAX 2000 PTY LTD), ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. HUSH-HUSH.COM (FAX 2000 PTY LTD) MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONSIN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE HUSH-HUSH.COM (FAX 2000 PTY LTD) WEBSITE. HUSH-HUSH.COM (FAX 2000 PTY LTD) DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE HUSH-HUSH.COM (FAX 2000 PTY LTD) WEBSITE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND HUSH-HUSH.COM (FAX 2000 PTY LTD) WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. LIMITATION OF LIABILITY:
IN NO EVENT SHALL HUSH-HUSH.COM (FAX 2000 PTY LTD), ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORISED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE HUSH-HUSH.COM (FAX 2000 PTY LTD) WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER ORNOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHILE THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION, WHERE CONDITIONS, WARRANTIES OR OTHER RIGHTS ARE IMPLIED IN THIS AGREEMENT OR OTHERWISE CONFERRED BY LAW, AND IT IS NOT LAWFUL OR POSSIBLE TO EXCLUDE THEM, THEN THOSE CONDITIONS, WARRANTIES OR OTHER RIGHTS WILL (BUT ONLY TO THE EXTENT REQUIRED BY LAW) APPLY TO THIS AGREEMENT. AT THE OPTION OF HUSH-HUSH.COM (FAX 2000 PTY LTD), OUR LIABILITY FOR BREACH OF IMPLIED CONDITIONS OR WARRANTIES IS LIMITED, TO THE EXTENT PERMITTED BY LAW TO, IF THE BREACH RELATES TO GOODS, (I) THE REPLACEMENT OF THE GOODS OR THE SUPPLY OF EQUIVALENT GOODS, (II) THE REPAIR OF THE GOODS, (III) THE PAYMENT OF THE COST OF REPLACING THE GOODS OR OF ACQUIRING EQUIVALENT GOODS, OR (IV) THE PAYMENT OF HAVING THE GOODS REPAIRED AND, IF THE BREACH RELATES TO SERVICES, (I) THE SUPPLY OF THE SERVICES AGAIN; OR (II) THE PAYMENT OF THE COST OF HAVING THE SERVICES SUPPLIED AGAIN.

YOU SPECIFICALLY ACKNOWLEDGE THAT HUSH-HUSH.COM (FAX 2000 PTY LTD) SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

INDEMNITY:
Hush-Hush.com (Fax 2000 Pty Ltd) accepts no responsibility for your actions or omissions, and you agree by accessing and/or using the website, to indemnify and hold harmless Hush-Hush.com (Fax 2000 Pty Ltd) and it's related bodies corporate and their employees, officers, agents, licensors and contractors from and against all actions, proceedings, suits, claims, demands and costs (on a full indemnity basis) brought or made against Hush-Hush.com (Fax 2000 Pty Ltd) by any person arising from or in consequence of such actions or omissions, and from and against any damage, loss, cost or expense suffered or incurred by Hush-Hush.com (Fax 2000 Pty Ltd) as a direct or indirect consequence thereof, including in relation to any content or material you contribute to or post on the website (including but not limited to blogs, chat rooms or forums and any video, audio, stills or other media files and material you access or post via the website).
You agree that Hush-Hush.com (Fax 2000 Pty Ltd) and it's agents, licensors and contractors may notify and/or cooperate with any authorities and law enforcement agencies in relation to any of your activities in relation to the website, including providing any and all information about held by Hush-Hush.com (Fax 2000 Pty Ltd), including your personal or other details, to those authorities and law enforcement agencies.
